RCN has agreed to pay $11.5 million to settle claims from consumers who allege they were charged a monthly NAM fee for their services in a way that didn’t follow New Jersey laws like the Consumer Fraud Act, the Consumer Contract Truth Act, and the New Jersey Uniform Declaratory Judgment Act. RCN Broadband Internet denies all of the claims, but to avoid paying legal fees and costs, the case was settled outside of court for $11.5 million. The settlement applies to RCN Broadband Internet users between November 1, 2017, and September 13, 2020.
The network access fees refer to the charges that internet service providers (ISPs) charge customers for using their services. In order to use the internet, you need to connect to the ISP’s network. ISPs charge different amounts based on how much bandwidth they provide to customers. These fees are commonly known as “network access fees.”
Network access fees differ from data usage fees because the latter only apply to the amount of data that you download or upload while using the internet. However, the former covers both types of fees.
Anyone who was or is a customer of RCN Broadband Internet between November 1, 2017 and September 13, 2022 and lives in the United States is eligible to be a part of this settlement. If you get a letter by mail or email, it means that you are a member of the class that this settlement is for. You can use the email receipt as proof to get your claim money.
The Claim Form must be sent by mail or online by January 11, 2023. If you don’t file by that date, you won’t get your settlement money. For further clarification, you can contact here.
If you sign up before February 17, 2019, you can get up to 40% of the NAM fee you paid in internet services. After February 17, 2019, you can get up to 80% of the NAM fee you paid in internet services. Other users can still get 20% even if they don’t meet the criteria above. Each member of the class can get up to $160, but that amount depends on things like how long they have been customers and what services they have used. You can get cash or bill credit for your claims, whichever you prefer.
Also, per the Settlement, the Defendants will update RCN’s website and other promotional materials to more clearly explain and highlight the NAM fees.
