Colgate-Palmolive has agreed to pay $1.9 million to resolve the claims of false advertising for Fabuloso’s (all-purpose) cleaner. The settlement was approved by a federal judge in February 2021. According to the class members Fabuloso lied to consumers by advertising false information about the products. The EPA (Environmental Protection Agency) requires that disinfectant products kill at least 99.9% of bacteria and viruses within six minutes of contact. However, Colgate-Palmolive’s testing showed that Fabuloso only killed 99.9% of bacteria within 10 minutes of contact.
The settlement requires Colgate-Palmolive to change the labeling and advertising for Fabuloso, and they must also stop the claims that Fabuloso is a disinfectant or sanitizer and clearly state the right information about the products. As consumers become increasingly aware of the importance of cleanliness and hygiene in the COVID-19 pandemic, it is very important for companies to ensure that their products live up to their marketing claims.
The settlement does not require proof of purchase, so hurry up and claim!
Anyone who meets the below eligibility criteria can join the settlement.
Customers who purchased Fabuloso products from January 1, 2009, to December 31, 2018 with a serial code starting with 2348US78, 2365US78, 3001US78, or 3023US78.
According to the settlement, compensation to the eligible class member will be given in the form of cash; however, the cash amount will depend upon the number of products they bought and on presenting proof of purchase.
Class members who submit an approved claim with proof of purchase of a potentially affected product will receive a full refund, capped at five (5) products with the highest price.
A class member who submits an approved claim but does not have proof of purchase can receive a full refund up to two (2) products per family.
The cash award amount is contingent on the number of claims, with a high number of claims resulting in a lower cash award.
To receive all the benefits, the class member needs to file a valid claim before March 13, 2024.
